จำนำ
การ จำนำ คือการที่ผู้จำนำส่งมอบทรัพย์สินที่เป็นสังหาริมทรัพย์ ซึ่งตนเป็นเจ้าของให้แก่ผู้รับจำนำเพื่อเป็นการประกันว่าตนจะชำระหนี้ (มาตรา ๗๔๗ และมาตรา ๗๔๘) และในกรณีที่ทรัพย์สินที่นำมาจำนำ มีตราสารหนี้ (ตราสารหนี้เป็นเอกสารที่ทำขึ้นตามกฎหมายและจะโอนกันได้ก็ต่อเมื่อโอนด้วย วิธีของตราสารนั้นๆ ตามที่กฎหมายกำหนด เช่น ใบหุ้น หรือตั๋วเงิน เป็นต้น) ผู้จำนำต้องแจ้งให้ผู้รับจำนำทราบ และต้องมอบตราสารหนี้นั้นให้ผู้รับจำนำไว้ด้วย (มาตรา ๗๕๐ มาตรา ๗๕๑ มาตรา ๗๕๒ และมาตรา ๗๕๓)
ในการบังคับจำนำ ผู้รับจำนำต้องแจ้งให้ผู้จำนำทราบล่วงหน้า ถ้าผู้จำนำยังเพิกเฉย ผู้รับจำนำอาจนำทรัพย์สินที่จำนำนั้นออกขายทอดตลาดได้ (มาตรา ๗๖๔ มาตรา ๗๖๕ มาตรา ๗๖๖ มาตรา ๗๖๗ และมาตรา ๗๖๘)
การจำนำสิ้นสุดเมื่อ หนี้ที่นำมาจำนำระงับไป เช่น มีการชำระหนี้กันแล้ว หรือได้หักกลบลบหนี้กันแล้ว เป็นต้น การที่ผู้รับจำนำยอมให้ทรัพย์สินที่จำนำกลับไปสู่การครอบครองของผู้จำนำย่อม ทำให้การจำนำสิ้นสุดลงเช่นกัน (มาตรา ๗๖๙)
